Contraloría ruled that a municipal ordinance imposing underground electrical channeling on new real estate projects lacks legal basis, as current laws do not mandate this for developers.

• Inmobiliaria Los Silos III Limitada challenged a Municipal Ordinance of Padre Hurtado (decreto N° 4.399/2013) that unlawfully imposed on developers the obligation to channel electrical distribution lines underground at their cost, conditioning final work reception.
• Article 134, inciso primero, of the Ley General de Urbanismo y Construcciones (LGUC) obliges landowners to execute energy installations at their expense for land urbanization, but it does not stipulate the installation method (aerial or underground).
