El tribunal acoge demanda por despido injustificado y nulidad, declarando la existencia de relación laboral y ordenando al ex empleador pagar indemnizaciones por aviso previo, años de servicio, remuneraciones y feriados adeudados, con intereses.

• A labor relationship existed between Nombre and CONSTRUCTORA INGEPHAZ LIMITADA from January 2, 2016, to August 20, 2018, during which the worker served as a carpenter and foreman, with a last monthly remuneration of $762,875 CLP.
• The worker performed services in facilities of SODIMAC S.A. under a sub-contracting regime.
• The plaintiff alleged and the court implicitly accepted the existence of pending vacation days (30 for 2016-2017 and 9 proportional for 2018) and non-payment of social security contributions by the employer.
• The dismissal was verbal, occurring on August 20, 2018, without the employer issuing a written notice or informing the Labor Inspection, thus violating Article 162 of the Labor Code.
