Penal - Rol N° O-7950-2017
MP C/
Abstracto
This document summarizes a legal case concerning the accusation of usurpation of name against ARRIZON ANTONIO CARO HERNÁNDEZ, who presented his brother's identity card during a police check. The case was processed in the Juzgado de Garantía de Talca. Initially, the Public Ministry qualified the action as usurpation of name under Article 214 of the Penal Code. However, the Tribunal re-qualified it as a misdemeanor of concealment of identity under Article 496 N°5 of the Penal Code, imposing a fine of one UTM, which was considered paid due to pre-trial detention. The defense argued that presenting a sibling's ID constituted concealment of identity rather than usurpation, an argument accepted by the court. The accused has previous records and is currently serving a sentence in another case. The court's decision was based on the interpretation that the intent was to hide one's identity, not to usurp another's name. Relevant legal provisions include Articles 496 N°5 and other articles of the Penal Code, as well as procedural code articles.
