Penal - Rol N° O-55-2022

MP CALAMA C/

Abstracto

This document details a court case from the Tribunal de Juicio Oral en lo Penal de Calama (RUC: 2100548121-7, RIT: 55-2022) dated July 15, 2022. The case involves a trial for quasi-homicide and other offenses. The incident occurred on June 8, 2021, when the accused, Dember Yonaiker González Porta, was driving a Chevrolet Sail (plate HBDP-47) with four passengers: Elimar Rangel García, Adriana Hernández Reyes, Joyner Escobar Acosta, and Yudimar Gutiérrez Rodríguez. Following a trip, the vehicle lost control and overturned due to excessive speed on route B-157, resulting in the deaths of Elimar Rangel García and Joyner Escobar Acosta at the scene. Adriana Hernández and Yudimar Gutiérrez sustained severe injuries. The accused and Adriana Hernández left the scene, with Adriana Hernández later dying at the Chiu Chiu clinic. The accused was apprehended at the Hospital Carlos Cisternas in Calama. He was convicted of three counts of quasi-homicide (Articles 391 N° 2 and 490 of the Penal Code) and one count of grievous bodily harm (Articles 397 N° 2 and 490 of the Penal Code), receiving a combined sentence of 818 days of medium-grade minor imprisonment. Additionally, he was convicted for delaying alcohol tests (Article 195 bis, inciso 2°, Law No. 18.290), receiving a sentence of 4 years of maximum-grade minor imprisonment, a lifetime driving ban, and a fine of ten UTM. The accused, born in Caracas on January 5, 2000, was a taxi driver without a Chilean driver's license and had no prior criminal record. The court acknowledged his prior irreproachable conduct (Article 11 N° 6, Penal Code) as a mitigating factor but rejected a claim for substantial collaboration. The confiscation of the vehicle was not ordered. The prosecution argued the accused was intoxicated and speeding, causing multiple fatalities. The defense contested the intoxication charge and requested a reclassification to quasi-homicide and grievous bodily harm. The court found the intoxication unproven but established the quasi-homicide and grievous bodily harm charges due to negligent speeding. The conviction for delaying alcohol tests was also upheld. Key legal provisions include Articles 391 N° 2, 397 N° 2, and 490 of the Penal Code, Article 195 bis of Law No. 18.290, and Article 11 N° 6 of the Penal Code. No alternative sentencing was granted, implying effective imprisonment. No appeals were mentioned, though Judge Nicolás Santibáñez dissented regarding the legal qualification of the offenses and the acquittal for delaying alcohol tests.
