La Corte Suprema declara inadmisible un recurso de nulidad subsidiario por supuesta infracción al debido proceso en caso de tráfico de drogas, al no corresponder la causal invocada a la alegada interpretación normativa de atenuante.

• Defense invoked subsidiary nullity under Art. 373(a) of the Code of Criminal Procedure, alleging violation of due process, presumption of innocence, and equality before the law, stemming from the denial of a mitigating circumstance (Art. 11 N° 6, Penal Code).
• Public Ministry requested inadmissibility of the subsidiary ground, asserting it exceeded the Supreme Court's competence and reiterated principal arguments.
• The Supreme Court determined that the defense's arguments concerning interpretation of a mitigating circumstance pertained to nullity ground Art. 373(b) of the Code of Criminal Procedure, not Art. 373(a), thus rendering the invoked subsidiary ground inadmissible.
