The court found that the accused, Germán Jorge Pérez and Ángel Ayala Mamani, were involved in communications regarding the acquisition and sale of drugs. Specifically, on May 28, 2021, they met in Arica for a drug handover. During this meeting, Ángel Ayala arrived in a Hyundai Porter, and Germán Jorge Pérez entered the vehicle. No incriminating evidence was found at Felipe Díaz Vicencio's residence.
Both Germán Jorge Pérez and Ángel Ayala Mamani were convicted of illicit trafficking of narcotics and psychotropic substances, as per Article 3 in conjunction with Article 1 of Law No. 20,000. They received a sentence of 3 years and 1 day of lesser prison (maximum degree), perpetual absolute disqualification from political rights and public offices, and a fine equivalent to ten monthly tax units. No aggravating factors were invoked. The presence of two mitigating factors led to a reduction in the penalty by one degree.
The prosecution argued that the drug trafficking offense was proven through phone intercepts, testimonies, and material evidence, seeking convictions for all three defendants. The defense for Germán Jorge Pérez admitted the offense and requested mitigation and expulsion. The defense for Ángel Ayala Mamani also admitted the facts and requested mitigation and supervised liberty. The defense for Felipe Díaz Vicencio argued for acquittal due to insufficient evidence.
The court's key findings were the proven facts and participation of Germán Jorge Pérez and Ángel Ayala Mamani, supported by PDI testimonies, wiretaps, material evidence, and their own statements. Felipe Díaz Vicencio was acquitted due to reasonable doubt stemming from insufficient evidence. Mitigating factors were recognized for Germán Jorge Pérez and Ángel Ayala Mamani, leading to their respective penalties of expulsion and intensive supervised liberty.
Relevant legal provisions include Article 3 in conjunction with Article 1 of Law No. 20,000 (illicit drug trafficking), Article 15 No. 1 of the Penal Code (authorship), Article 11 No. 6 and No. 9 of the Penal Code (mitigating factors), Article 68 paragraph 3 of the Penal Code (penalty determination), Article 70 of the Penal Code (fine calculation), Article 34 of Law No. 18,216 (expulsion requirements), Article 15 bis of Law No. 18,216 (intensive supervised liberty), Article 31 of the Penal Code (confiscation), Article 45 of Law No. 20,000 (vehicle and money confiscation), and Article 17 of Law No. 19,970 (genetic fingerprinting).
